Welcome to Valor Health. These Terms of Service ("Terms") govern your access to and use of https://www.valor-health.us (the "Site"), as well as all consultations, physiological and metabolic assessments, body composition scans, at-home biomarker lab kits, educational content, and fitness, nutrition, and lifestyle coaching memberships offered by Valor Performance and Wellness LLC, doing business as Valor Health ("Valor Health," "we," "us," or "our").
By accessing the Site, booking a consultation or assessment, purchasing a product or membership, or otherwise using our services, you agree to be bound by these Terms and our Privacy Policy (www.valor-health.us/privacy-policy). If you do not agree to these Terms, do not use the Site or our services.
1. Legal Entity, Location & Corporate Separation
1. Operating Entity: The Site and the services described in these Terms are operated by Valor Performance and Wellness LLC, a Florida limited liability company doing business as Valor Health, located at 1947 A1A S, Suite A, St. Augustine, FL 32080 (Email: support@valor-health.us | Phone: 1-866-717-7010).
2. Independent Company — Separation from Better Bodies: Valor Health operates from leased commercial space inside the Better Bodies facility at 1947 A1A S, Suite A, St. Augustine, FL 32080. Valor Health is a separate and independent legal entity from Better Bodies Personal Training LLC ("Better Bodies") and any other business operating at or near the premises. Enrolling in a Valor Health membership or booking a Valor Health assessment does not grant gym membership or facility access rights at Better Bodies unless separately contracted with Better Bodies, and Better Bodies is not a party to, or liable for, any services or agreements between you and Valor Health.
2. Important Non-Medical Disclaimer (Coaching, Physiological Testing & Lab Kits)
1. Wellness, Fitness & Educational Scope Only: Valor Health is a health, fitness, metabolic testing, and lifestyle optimization coaching company—not a licensed medical provider, physician practice, healthcare clinic, or clinical laboratory.
2. No Medical Advice, Diagnosis, or Treatment: All services, assessments, products, and content provided through www.valor-health.us—including but not limited to:
• Initial Consultations and member follow-up reviews;
• Fitness, strength training, nutrition, and lifestyle optimization coaching (including the Lifestyle Optimization Protocol and educational peptide or wellness protocol support);
• PNOĒ VO2 Max Assessments ($125), PNOĒ Resting Metabolic Rate (RMR) Assessments ($100), and Combined VO2 Max + RMR Packages ($200);
• Evolt 360 Body Composition Scans ($30);
• Quarterly biomarker lab panels and At-Home Blood Biomarker Collection Kits ($190–$310); and
• Articles, guides, and AI assistant responses on the Site—
are provided solely for educational, informational, fitness, and general wellness purposes. They do not constitute the practice of medicine, medical care, medical advice, clinical diagnosis, prognosis, or treatment of any disease or medical condition.
3. No Physician-Patient Relationship: Your use of www.valor-health.us or participation in Valor Health coaching or physiological testing does not create a physician-patient or healthcare provider-patient relationship between you and Valor Health or any Valor Health coach, exercise physiologist, or staff member.
4. Consult Your Physician: Always consult a licensed physician or qualified healthcare provider before beginning any new exercise, nutrition, fasting, supplement, or wellness program, or if you have any questions regarding a medical condition. Never disregard professional medical advice, delay seeking medical care, or stop or alter any prescribed medication or treatment plan because of information, test readouts, or coaching received through Valor Health.
5. Medical Emergencies: DO NOT USE THE SITE OR VALOR HEALTH SERVICES FOR MEDICAL EMERGENCIES. If you experience chest pain, shortness of breath, fainting, severe dizziness, or any other medical emergency, call 911 or go to the nearest emergency room immediately.
3. Clinical Telehealth & Pharmacy Separation (shop.valor-health.us)
1. Independent Clinical Portal: Physician consultations, medical evaluations, and prescription therapies—including hormone or testosterone replacement therapy (TRT/HRT), medical weight management (GLP-1 protocols), and clinician-prescribed peptide or longevity therapies—accessed via our separate clinical portal at https://shop.valor-health.us are provided independently by licensed third-party healthcare providers and fulfilled by independent licensed pharmacies (and/or licensed manufacturers) following an independent medical evaluation.
2. Clinical Independence: Valor Health does not practice medicine, employ or direct prescribing clinicians in their clinical judgment, issue prescriptions, or dispense prescription drugs. Prescriptions are issued solely if and when an independent licensed provider determines that a therapy is clinically appropriate for you after evaluation. Not all applicants qualify for prescription therapy.
3. Separate Clinical Terms & Consents: Any medical consultations, health intake information, or orders placed on shop.valor-health.us are governed by the separate Terms & Conditions, Telehealth Informed Consents, and Privacy/HIPAA policies posted on shop.valor-health.us.
4. Compounded Medications Notice: Where a licensed clinician on shop.valor-health.us prescribes a compounded medication fulfilled by a licensed 503A compounding pharmacy, please note that compounded medications are customized preparations that are not FDA-approved, and the U.S. Food and Drug Administration (FDA) does not verify the safety, effectiveness, or quality of compounded medications prior to marketing.
4. Eligibility & Age Minimum (18+ / 21+)
1. General Website, Coaching & Physiological Testing (18+): You must be at least eighteen (18) years of age and legally capable of entering into a binding contract to access www.valor-health.us, book an Initial Consultation or standalone physiological/metabolic assessment (PNOĒ VO2 Max, PNOĒ RMR, Evolt 360), purchase an At-Home Blood Biomarker Kit, or enroll in a Valor Health coaching membership.
2. Clinical & Telehealth Protocols (21+ Where Applicable): Certain physician-prescribed therapies, hormone optimization protocols, and telehealth services offered on shop.valor-health.us require patients to be at least twenty-one (21) years of age or meet additional clinical and state residency requirements established by the evaluating medical provider.
5. Initial Consultation ($249), Schedule Request Mode & Cancellation Policy
1. Initial Consultation ($249.00): Prospective members begin with a 60-minute Initial Consultation ($249.00 USD), available In-Person at our St. Augustine facility (1947 A1A S, Suite A, St. Augustine, FL 32080) or Virtual.
• In-Person Initial Consultation ($249.00): Includes a 60-minute consultation, baseline Evolt 360 body composition scan, health history and biomarker review, metabolic and wellness education, and a personalized coaching roadmap.
• Virtual Initial Consultation ($249.00): Includes a 60-minute virtual consultation, health history and biomarker review, metabolic and wellness education, and a personalized coaching roadmap.
2. Schedule Request Mode: Online booking for Initial Consultations (and standalone testing appointments) operates in Schedule Request mode:
• Payment of $249.00 (or payment authorization with a valid payment card on file) is collected at the time you submit your appointment request.
• Your requested date and time slot are confirmed upon Valor Health staff review and approval (typically within 24 hours).
• If Valor Health cannot accommodate your requested time slot and a mutually agreeable alternate time cannot be scheduled, your $249.00 payment will be refunded in full.
3. 100% Credit Toward Month 1 of Membership: If you enroll in any Valor Health Performance & Longevity Membership tier (Foundation, Optimum, Precision, or Elite) following your Initial Consultation, 100% of your paid $249.00 Initial Consultation fee will be credited toward your first month's membership fee. If you choose not to enroll in a membership, the $249.00 fee covers the completed 60-minute consultation and is non-refundable once the consultation has taken place.
4. 24-Hour Rescheduling, Late Cancellation & No-Show Policy ($50.00 Fee):
• You may cancel or reschedule a confirmed Initial Consultation free of charge by notifying Valor Health at least twenty-four (24) hours before your scheduled appointment time via email at support@valor-health.us or phone at 1-866-717-7010.
• Any cancellation or rescheduling request made with less than 24 hours' advance notice, or failure to arrive for a confirmed appointment (no-show), is subject to a $50.00 late cancellation / no-show fee, which will be charged to your card on file or deducted from your consultation payment.
6. Memberships, Firm 90-Day Minimum Commitment, Automatic Renewal & Cancellation
1. Membership Tiers & Monthly Pricing: Valor Health offers four structured Performance & Longevity Membership tiers on www.valor-health.us/membership, billed monthly:
• Foundation Membership: $249.00 / month *(Quarterly Lab Panel, Monthly Evolt 360 Scan, Monthly In-Person Progress Review, Weekly Basic Check-Ins, Basic Nutrition & Exercise PDF Guides, Quarterly Progress Assessment)*
• Optimum Membership: $349.00 / month *(Quarterly Lab Panel, Monthly Evolt 360 Scan + In-Person Review, Quarterly PNOĒ VO2 Max Testing, Quarterly PNOĒ RMR Testing, Coaching App Access, Personalized Nutrition Targets & Structured Exercise Programming in App, Weekly App-Based Check-Ins)*
• Precision Membership: $449.00 / month *(Everything in Optimum, plus Expanded Quarterly Lab Panel, Detailed Nutrition Programming & Macro Periodization, Individualized Exercise Progression via Coaching App Access, Enhanced App Tracking & Habit Programming, Personalized Weekly Coaching Feedback)*
• Elite Membership: $599.00 / month *(Everything in Precision, plus Comprehensive Quarterly Lab Panel, Highest Level of Individualized Nutrition & Exercise Programming, Advanced Coaching App Refinements, Priority Coaching Responses, Enhanced Accountability & Priority Scheduling)*
*(Optional hands-on add-ons, including In-Person Personal Training and 1-on-1 Nutrition Coaching, are quoted separately upon consultation.)*
2. Firm 90-Day (3-Month) Minimum Commitment:
• All Valor Health memberships require a firm ninety-day (90-day / 3-month) minimum commitment, billed monthly across your first three consecutive monthly billing cycles (with your paid $249.00 Initial Consultation credited 100% toward Month 1).
• By enrolling in a membership, you authorize Valor Health to charge your payment method on file for each monthly billing cycle during the initial 90-day commitment period.
• Except as expressly required by applicable law (see Section 6.5), memberships cannot be canceled early for convenience during the initial 90-day (3-month) commitment period.
3. Automatic Month-to-Month Renewal Disclosure:
> IMPORTANT AUTOMATIC RENEWAL NOTICE: Following the completion of your initial 90-day (3-month) minimum commitment, your Valor Health membership will automatically renew on a month-to-month basis at the applicable monthly membership rate ($249.00/mo for Foundation, $349.00/mo for Optimum, $449.00/mo for Precision, or $599.00/mo for Elite, plus any applicable taxes) on your recurring monthly billing date until you cancel in accordance with Section 6.4 below.
4. How to Cancel After the 90-Day Commitment (7-Day Advance Email Notice):
• Once your membership has completed its initial 90-day (3-month) commitment and entered month-to-month renewal, you may cancel your membership by sending written cancellation notice by email to support@valor-health.us at least seven (7) calendar days before your next scheduled monthly billing date (or through your online member account settings on www.valor-health.us, where enabled).
• Please include your full name and the email address associated with your membership in your cancellation email. Valor Health will send an email confirmation acknowledging your cancellation.
• Notice Timing: If your cancellation notice is received at least 7 days prior to your next monthly billing date, you will not be charged for the upcoming billing cycle, and your membership access will continue through the end of your current paid billing period. If your cancellation notice is received fewer than 7 days before your next scheduled monthly billing date, your next monthly charge will process as scheduled and your cancellation will take effect at the conclusion of that following monthly billing period.
5. No Prorated Refunds; Statutory Consumer Rights:
• Membership payments are non-refundable once billed, and Valor Health does not issue prorated refunds or credits for partial months or unused assessments, scans, lab panels, or coaching check-ins. Included membership services are personal to the enrolled member, cannot be transferred to another individual, and carry no cash value.
• Florida Statutory Rights Preserved: Nothing in these Terms waives or limits any non-waivable cancellation or refund right to which you may be entitled under applicable Florida law (including, to the extent applicable to any in-person physical training services, statutory rights under the Florida Health Studio Services Act, Fla. Stat. §§ 501.012–501.019).
7. Standalone Physiological Testing & At-Home Blood Biomarker Kits
1. Standalone In-Person Physiological Assessments: Clients may book individual assessments at 1947 A1A S, Suite A, St. Augustine, FL 32080 via Schedule Request mode without enrolling in a monthly membership:
• PNOĒ VO2 Max Assessment: $125.00 *(Active graded exercise breath-by-breath gas exchange analysis + 15-minute coaching review)*
• PNOĒ Resting Metabolic Rate (RMR) Assessment: $100.00 *(Resting breath-by-breath indirect calorimetry analysis + 15-minute coaching review)*
• Combined PNOĒ Metabolic Package (VO2 Max + RMR): $200.00 *(Includes both PNOĒ VO2 Max and PNOĒ RMR assessments + 30-minute coaching review)*
• Evolt 360 Body Composition Scan: $30.00 *(60-second segmental bioelectrical impedance scan + baseline readout)*
• Standalone testing appointments are booked in Schedule Request mode (confirmed upon staff approval) and require at least 24 hours' advance notice to cancel or reschedule. Late cancellations (<24 hours) or no-shows are subject to the $50.00 late cancellation / no-show fee (or the full $30.00 scan fee for a standalone Evolt 360 appointment).
2. At-Home Blood Biomarker Collection Kits (/shop — $190.00 to $310.00):
• Valor Health offers five capillary blood collection kits on www.valor-health.us/shop: Core Health ($190.00), GLP & Cardio ($200.00), HRT Monitoring ($200.00), Women's Hormone Health ($210.00), and Ultimate Health ($310.00).
• Independent Partner Lab Processing: Samples are processed by an independent CLIA-certified, CAP-accredited partner laboratory (SiPhox Health). Lab results and Valor Health's coaching review of your biomarkers are provided strictly for wellness monitoring, fitness, and educational purposes and do not constitute a medical diagnosis or clinical lab order for disease treatment.
• Age & State Restrictions: You must be 18 years of age or older to purchase or use an at-home lab kit. Due to state laboratory regulations, at-home lab kits are not available for sale or shipment to residents of New York (NY) or Hawaii (HI), or any other restricted jurisdiction indicated at checkout.
• No Returns on Shipped Test Kits: Because at-home biomarker kits contain medical specimen collection supplies, all sales are final once a kit has shipped. If a kit arrives damaged or defective, contact support@valor-health.us within seven (7) days of delivery for a replacement.
8. Health Screening, Contraindications & Express Assumption of Risk
1. Mandatory Intake & In-Person Liability Waiver: Before participating in an Initial Consultation, physiological assessment, body composition scan, or coaching program, you must provide accurate and complete information on Valor Health's Pre-Consultation Intake Form (www.valor-health.us/intake) and execute Valor Health's separate written Informed Consent, Health Waiver, and Release of Liability.
2. Testing Contraindications — When You Must Not Test:
• PNOĒ VO2 Max Graded Exercise Testing: Involves strenuous, maximal or near-maximal physical exertion on a treadmill or stationary bicycle. You must NOT undergo PNOĒ VO2 Max testing at Valor Health if you have an acute or unstable cardiovascular, pulmonary, or metabolic condition, including recent heart attack or stroke, unstable angina or chest pain, uncontrolled cardiac arrhythmia, uncontrolled high blood pressure, decompensated heart failure, or an acute blood clot (DVT/PE). Anyone with known or suspected heart or lung disease should only perform maximal exercise testing in a physician-supervised clinical laboratory with ECG monitoring.
• PNOĒ RMR Testing: Requires fasting (water only) and avoiding caffeine, nicotine, and stimulants for at least 4–5 hours beforehand. Never stop taking a prescribed medication before a test unless directed to do so by your prescribing healthcare provider.
• Evolt 360 Body Composition Scan (Bioelectrical Impedance Analysis): Passes a low-level electrical current through the body. You must NOT use the Evolt 360 scanner if you have a cardiac pacemaker, implantable cardioverter-defibrillator (ICD), or any other implanted electronic medical device, or if you are pregnant (unless cleared in writing by your physician).
3. Express Assumption of Risk: You understand and acknowledge that physical exercise, graded exercise testing (VO2 Max), strength training, dietary/caloric adjustments, and capillary blood collection involve inherent risks of physical injury or adverse physiological response, including musculoskeletal strains, abnormal blood pressure, dizziness, fainting, or rare cardiovascular events. To the fullest extent permitted by Florida law, you voluntarily assume all known and unknown risks associated with your participation in Valor Health assessments, lab kits, and coaching services.
9. Electronic Communications & SMS/Text Messaging Terms
1. Consent to Electronic & SMS Communications: By providing your email address or mobile phone number on www.valor-health.us and opting in, you consent to receive transactional and service-related emails and SMS/text messages from Valor Health (including appointment confirmations, schedule request updates, intake links, and customer support messages), as well as marketing communications where you have specifically opted in to receive them.
2. No Condition of Purchase: Your consent to receive marketing text messages or marketing emails is not a condition of purchasing any product, booking any consultation, or enrolling in any membership.
3. Opt-Out & Support (STOP / HELP): Message frequency varies. Standard message and data rates may apply. You can opt out of SMS messages at any time by replying STOP to any text message from Valor Health. For help, reply HELP or contact us at support@valor-health.us or 1-866-717-7010. You can opt out of marketing emails at any time by clicking the Unsubscribe link in any promotional email.
10. Intellectual Property & Acceptable Use
1. Ownership of Content: All text, graphics, logos, training plans, nutrition guides, PDF resources, videos, trademarks, and software on www.valor-health.us are owned by or licensed to Valor Performance and Wellness LLC d/b/a Valor Health and are protected by United States copyright, trademark, and intellectual property laws.
2. Limited Personal License: Coaching materials, nutrition targets, workout programs, and PDF guides provided to you as part of a consultation or membership are licensed solely for your personal, non-commercial use. You may not copy, reproduce, resell, publish, or distribute Valor Health coaching materials to third parties without our prior written consent.
11. Disclaimer of Warranties & Limitation of Liability
1. No Guarantee of Specific Results: Individual fitness, body composition, metabolic, biomarker, and wellness outcomes vary depending on genetics, baseline health, consistency, adherence, sleep, and lifestyle factors outside Valor Health's control. Valor Health makes no representations, warranties, or guarantees regarding specific weight loss, muscle gain, biomarker improvements, or athletic results.
2. "AS IS" Disclaimer: To the fullest extent permitted by applicable law, the Site and all Valor Health services, assessments, and materials are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
3. Limitation of Liability: To the fullest extent permitted by Florida law, in no event shall Valor Performance and Wellness LLC d/b/a Valor Health, its owners, members, managers, employees, coaches, or contractors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages arising out of or related to your use of the Site or our services. Valor Health's total cumulative liability for any claims arising out of or relating to these Terms or our services shall not exceed the total fees actually paid by you to Valor Health during the three (3) months immediately preceding the event giving rise to the claim, or $249.00, whichever is greater.
12. Indemnification
You agree to indemnify, defend, and hold harmless Valor Performance and Wellness LLC d/b/a Valor Health and its officers, managers, employees, coaches, and agents from and against any third-party claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or connected with: (a) your breach of these Terms; (b) your failure to disclose relevant health conditions or contraindications prior to testing or coaching; or (c) your misuse of the Site or our services.
13. Governing Law, Venue & Dispute Resolution (Florida Law)
1. Governing Law: These Terms and any dispute or claim arising out of or relating to the Site or Valor Health's services shall be governed by and construed in accordance with the internal laws of the State of Florida, without giving effect to any choice or conflict of law provision.
2. Informal Resolution First (30-Day Notice): Before initiating any arbitration or court proceeding, the complaining party must first send a written Notice of Dispute describing the nature and basis of the claim and the relief sought to the other party (to Valor Health at support@valor-health.us and 1947 A1A S, Suite A, St. Augustine, FL 32080) and allow thirty (30) calendar days for the parties to attempt in good faith to resolve the dispute informally.
3. Binding Individual Arbitration & St. Johns County, Florida Venue:
• Except for individual claims that qualify for small claims court in St. Johns County, Florida, or claims seeking injunctive relief for intellectual property misuse, any dispute not resolved within thirty (30) days after written Notice of Dispute shall be resolved by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, with any in-person hearing held in St. Johns County, Florida.
• For any court proceeding permitted under these Terms (including small claims actions or proceedings to enforce an arbitration award), the parties irrevocably consent to the exclusive personal jurisdiction and venue of the state and federal courts located in or serving St. Johns County, Florida.
4. Class Action Waiver: To the fullest extent permitted by law, all disputes shall be resolved on an individual basis only, and neither you nor Valor Health may bring a claim as a plaintiff or class member in any purported class, collective, or representative proceeding.
14. Changes to These Terms, Severability & Contact Information
1. Changes to Terms: We may update these Terms from time to time. When we do, we will post the updated Terms on this page and revise the "Last Updated" date at the top. Material changes affecting active memberships will be communicated to active members by email at least thirty (30) days prior to taking effect.
2. Severability & Entire Agreement: If any provision of these Terms is held to be invalid or unenforceable under Florida law, that provision shall be enforced to the maximum extent permissible and the remaining provisions shall remain in full force and effect. These Terms, together with our Privacy Policy (www.valor-health.us/privacy-policy) and any signed client intake/waiver agreements, constitute the entire agreement between you and Valor Health regarding the Site and the services offered on www.valor-health.us.
